These Terms of Use ("Terms") govern your use of TVivia (the "Service"), operated by GiftMwah LLC ("we", "us"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Using the Service
- The Service is provided for entertainment. You may use it at home or in a venue such as a bar or restaurant, free of charge.
- You are responsible for the display names and text you enter. Don't enter anything offensive, hateful, harassing, sexually explicit, or anyone's personal information. Hosts may remove players, and we may remove content or restrict access at our discretion.
- Don't attempt to disrupt, hack, overload, scrape or reverse-engineer the Service, interfere with other players' games, or use automated means to play.
- Don't hide, block, cover or interfere with advertisements, and don't click ads in any way intended to generate invalid activity.
Trivia content
We work to keep questions and answers accurate, but trivia content may contain errors or become outdated. Content is provided "as is" for entertainment only and should not be relied on as a source of fact. If you spot a mistake, please let us know at support@giftmwah.com.
TV shows, films, characters, parks and brands mentioned in questions are trademarks of their respective owners. TVivia is not affiliated with, sponsored by or endorsed by any of them.
Prizes and venues
If a venue or host offers prizes, that is solely between the venue or host and the players. We are not responsible for any prizes, promotions or contests run using the Service. Venues are responsible for complying with any laws that apply to their promotions.
Our content
The Service, including its design, software and question collection, is owned by GiftMwah LLC and protected by intellectual property laws. You may not copy, republish or distribute our questions or other content without our permission.
Advertising
The Service is supported by third-party advertising. We are not responsible for the content of third-party ads or the websites they link to. See our Privacy Policy for how advertising cookies are used.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, error-free or available on every device or browser.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GIFTMWAH LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Changes
We may change the Service or these Terms at any time. Continued use after changes means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
